Terms of Use

1. Acceptance of these Terms

By clicking "I Agree" or "Accept" when creating your user account within the app, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the app or any of its services.

2. Warranty and Liability Disclaimer

This application is still in development, currently in the stage of beta testing and is provided strictly on an "AS IS" basis. By using this application, you acknowledge and agree that the app is not final and may contain bugs or incomplete features. There is no guarantee as to functionality or availability of the App. It can be interrupted, modified, or discontinued at any time without any prior notice. You use the App entirely at your own risk. To the maximum extent permitted by law, we disclaim all warranties expressed or implied for functionality, fitness for purpose, and lack of errors in the App. We shall not be liable for any damages arising from your use of the App. We particularly disclaim liability for any data you enter into the App.

3. User Content Responsibility

You are solely and entirely responsible for all content you upload, share, or post on the App ("User Content"). By submitting User Content, you represent and warrant that:

You own all rights to your User Content or have obtained all necessary permissions and licenses
Your User Content does not infringe upon any third party's intellectual property rights, including but not limited to copyrights, trademarks, or patents
You will not upload music, audio, or other content that you do not have the legal right to share
Your User Content complies with all applicable laws and regulations
Your User Content does not contain any:
- Obscene, pornographic, or sexually explicit material
- Hate speech, discriminatory language, or content promoting violence
- Defamatory, harassing, or threatening content
- Spam, malicious code, or fraudulent material
- Content that violates any federal, state, or local laws or any jurisdiction

We reserve the right to remove any User Content and terminate accounts that violate these standards.

4. Zero Tolerance for Objectionable Content and Abusive Users

There is no tolerance for objectionable content or abusive users on Jam Scsh. The content prohibited by Section 3 is not permitted anywhere on the Service, and neither is abusive behaviour towards other people using it — including harassment, bullying, threats, hate speech, sexual harassment, and impersonation.

You can report content or an account that breaks these rules from within the app. We review every report and act on it within 24 hours.
Where a report is upheld we remove the content, and we may suspend or permanently terminate the account responsible.
You can block any account from its profile. Blocking removes that account's content from your experience of the Service.
Posting objectionable content, or abusing another user, is a breach of these Terms and is grounds for immediate termination under Section 8.

5. Your Data

We use the information you provide and your activity in the App (for example the videos you watch, like, skip or follow) to run the Service: to personalise your feed and recommendations, keep the Service safe, and improve it.

We use service providers to host, analyse and operate the Service — including Google Firebase, Cloudflare, PostHog, Upstash, Stripe and SendGrid — and they process your data only on our behalf. We do not sell your personal data and we do not use it for advertising.

Our Privacy Policy explains how we collect, use, share and protect your data, and your rights over it.

6. Promotional Credits and Referral Program

Jam Scsh may offer referral or promotional programs that grant promotional jAmp credits — for example, 100 promotional jAmps (an in-app value of approximately $1) for joining through a participating artist's invite link or code. Unless we say otherwise for a specific program, promotional credits:

Can be used only to send tips to the referring artist — the artist whose invite link or code you used
Cannot be withdrawn, transferred, or redeemed for cash, and have no monetary value outside the App
Are separate from purchased or earned jAmps, and are spent first when you tip the referring artist
May be modified, expired, or revoked by Jam Scsh at any time, and any promotional program may be changed or ended without notice
Are void if obtained or used through fraud or abuse (for example fake, duplicate, or automated accounts); we may revoke the credits and any related tips, and terminate the accounts involved

Tips an artist receives that were funded by promotional credits are treated as ordinary earned jAmps for that artist. When you participate in a referral program, we record referral information as described in our Privacy Policy.

7. Amendments

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting. Your continued use of the App after any modifications indicates your acceptance of the updated Terms.

8. Termination

We may terminate or suspend your account and access to the App at any time, without prior notice or liability, for any reason, including but not limited to breach of these Terms.
